1 Conclusion of contract and services

The contract between the guest and the landlord is concluded with the unconditional confirmation of the reservation. These booking conditions apply to all travel participants. The services are set out in the service description in the contract or the confirmation. The number of persons stated in the contract must be respected in any case. We cannot accept any liability for changes made without our knowledge after printing or for any printing errors, for which we apologize.

2. Prices

The prices listed in the contract in Swiss francs are binding. Prices may be adjusted in the event of the introduction or increase of taxes, duties and levies up to 3 weeks before the start of the contract.

3 Terms of payment

The terms of payment are set out in the contract. A deposit is required upon conclusion of the contract. The remaining amount must be transferred before arrival or paid in cash on departure. (see contract)

4. Changes and cancelations (annulment) of the contract by the guest

The cancellation conditions in the contract apply. If these are not specified in the contract, the following cancellation conditions apply:

  • If you withdraw from the offer 45 days before the booked date for a reason that is not covered by the cancellation costs protection or by an insurance policy you have taken out, you will be charged the following amounts as a percentage of the offer:
    • Up to 45 days: processing fee of CHF 100.
    • 44-30 days before the start of the package: 50 % of the package price
    • 29-0 days before the start of the arrangement and no-show: 100% of the arrangement price
  • The date of receipt of the notification is decisive; in the case of Saturdays, Sundays or public holidays, the next working day is decisive. Cancellations must be communicated to the landlord in writing.
  • It is advisable for the guest to take out cancellation insurance (5% of the total price). This insurance covers the cancellation risk in cases of hardship. Cases of hardship include illness, accident or death of the insured person or a person close to them. The corresponding proof must be provided in writing and is subject to verification by a medical examiner.
  • A processing fee of CHF 100 per booking will be charged in all cases (not covered by the cancellation cost protection).
  • If the guest is unable to take up the booked arrangement but is able to inform us of a replacement person, no additional costs will be incurred.

5. Force majeure

Extreme events can always occur in vacation travel which the landlord cannot prevent. If force majeure, environmental disasters or forces of nature prevent us from carrying out our agency activities, we are entitled to cancel the booking without compensation.  If other reasons, for which we are also not responsible, prevent us from providing the service, we can either rebook you into another apartment or, if necessary, cancel the booking. For the above-mentioned reasons, you will be refunded the amount paid if you do not make use of the service, but you waive any further claims.

6 Liability

The landlord is liable for the proper reservation on site. However, the landlord is not liable for unforeseeable circumstances that cannot be influenced by the landlord, such as:

  • failures or disruptions in the water and/or electricity supply and facilities such as heating, elevator, swimming pool, etc.
  • reduction in the rental value due to environmental damage, temporary increased noise emissions, e.g. construction site, party, etc.

Each participant is responsible for their own personal insurance cover (in particular accident and health insurance, damage to property and luggage and loss of luggage). The organizers decline any liability. The guest must pay in full for any damage demonstrably caused by the guest during their stay.  Any damage must be reported to the owner or his representative before departure.

7 Late arrival, early departure

The guest is responsible for their own arrival. In the event of late arrival due to disruptions and obstructions in public and private transportation (including rail and air), etc., as well as for personal reasons, no refund will be made. In the event of early departure, the full amount remains due.

8 Complaints

If there are any defects when you move into the property, or if they occur later, if you suffer damage or have any other cause for complaint, this must be reported to the landlord immediately. The landlord will endeavor to take appropriate remedial action. We would like to point out that complaints or any claims can only be dealt with after notification within 72 hours of using the service. These claims must also be submitted to the landlord in writing within 10 days of the duration of the stay, otherwise any claim for compensation will lapse. The claim for damages shall in no case exceed the amount of the rental sum.  Furthermore, Swiss law shall apply. Visp (Switzerland) is agreed as the place of jurisdiction.

9. Validity of translation
